End User License Agreement (EULA)

This End User License Agreement ("Agreement") is between you and Nileva SRL ("Company", "we", "us", or "our") regarding your use of the Caoschef mobile application ("App").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to the terms of this Agreement.

3. Subscription Terms

3.1 Free Trial

New users receive a 3-day free trial period. During this period, you have access to premium features at no cost.

3.2 Auto-Renewable Subscriptions

The App offers the following subscription options:

• Monthly Subscription: Billed monthly
• Yearly Subscription: Billed annually with a 3-day free trial

3.3 Payment and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

3.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.

4. Use of the App

4.1 Permitted Use

You may use the App to:

• Generate recipe suggestions based on available ingredients
• Scan images to detect ingredients
• Access cooking instructions and nutritional information
• Use the cooking mode feature

4.2 Prohibited Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App
• Use the App in any manner that could damage, disable, or impair the service

5. AI-Generated Content

The App uses artificial intelligence to generate recipe suggestions. While we strive for accuracy:

• Recipe suggestions are provided "as is" without warranties
• We are not responsible for the outcome of recipes you prepare
• Always use your judgment regarding food safety and dietary restrictions
• Consult healthcare professionals for specific dietary advice

6. Privacy and Data

Your use of the App is also governed by our Privacy Policy, available at: https://ermixserdar.github.io/privacy/privacy-policy.html

Key privacy points:

• We do not collect or store personal data
• All data remains on your device
• Images uploaded for ingredient detection are processed via third-party AI services
• We comply with GDPR and KVKK regulations

7. Intellectual Property

The App and all its content, features, and functionality are owned by Nileva SRL and are protected by international copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NILEVA SRL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Third-Party Services

The App uses third-party services including:

• Groq API for AI-powered recipe generation and image analysis
• Apple In-App Purchase for subscription management

Your use of these services is subject to their respective terms and conditions.

11. Changes to Terms

We reserve the right to modify this Agreement at any time. We will notify you of any changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified terms.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of this Agreement. Upon termination, your right to use the App will immediately cease.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

For users who download the App from the Apple App Store, the following additional terms apply:

• This Agreement is between you and Nileva SRL, not Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims relating to the App
• Apple and its subsidiaries are third-party beneficiaries of this Agreement

16. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Nileva SRL regarding the use of the App.
